Проблема:
Непроста економічна ситуація в державі та інші обставини змусили, за різними підрахунками від 3 до 7 млн. громадян України, стати трудовими мігрантами. Заробітчани та їхні сім’ї є заручниками такої ситуації. З іншого боку, і для нашої країни існують значні загрози щодо таких міграційних процесів.
Разом із цим, наша держава і досі не виробила системної державної політики (policy) стосовно питань трудової міграції, захисту прав мігрантів та повернення українських заробітчан додому.
Відсутність належних та елементарних правових знань законодавства країн перебування українських заробітчан сприяє різним формам порушень їх прав, свобод та законних інтересів, в тому числі трудових прав, різноманітних форм дискримінації.
Трудові мігранти, в залежності від країни перебування, потребують щонайменше захисту та допомоги від держави, а також ефективної юридичної підтримки та безкоштовного правового консультування.
Наявні можливості правової допомоги є недостатніми для всебічної обізнаності громадян України – трудових мігрантів про свої права та механізми їх ефективного юридичного захисту у країні перебування.
Поширена практика дискримінації за ознаками громадянства, нетерпимості та стереотипів у країнах перебування стосовно українських заробітчан.
Цілі:
Експертна розробка, обговорення та лобіювання стратегії державної політики (policy) у сфері трудової міграції, а також підготовка змін до українського законодавства щодо відповідної проблематики.
Покращення правової освіти та обізнаності громадян України, які працюють за кордоном чи мають намір виїхати за межі держави з метою пошуку роботи про їхні права, свободи та законні інтереси у країні перебування.
Забезпечення створення правозахисної мережі та юридичної підтримки прав, свобод та законних інтересів українських заробітчан.
Проведення інформаційної кампанії з питань механізмів реалізації та захисту прав трудових мігрантів, а також запобігання дискримінаційному та нетерпимому ставленню (відношенню) до українських заробітчан.
Заходи:
Підготовка, обговорення та лобіювання стратегії державної політики (policy) у сфері трудової міграції, а також проектів законодавчих актів.
Формування та діяльність групи експертів, внесення та публічне обговорення Білої книги («White Paper») у сфері трудової міграції із громадськістю і стейкголдерами (заінтересованими сторонами) та подальшого впровадження органами виконавчої влади.
Розробка та запровадження інтернет-платформи «Юридичний захист українських заробітчан», а також мобільного-додатку із розміщенням юридичних консультацій, практичних порад, зразків документів, варіантів реагування на порушення прав у кожній типовій ситуації.
Підготовка та розміщення серії правозахисних відео-блогів із «історіями успіху» щодо відстоювання та захисту прав, свобод та законних інтересів українських громадян у країні перебування.
Підготовка та поширення буклетів, інфографіки і практичних посібників з питань покращення правової обізнаності українських заробітчан (в т.ч. стосовно реалізації і захисту трудових прав).
Підготовка та безкоштовне поширення зразків типових скарг, звернень, судових документів країни перебування українського громадянина (наприклад, зразок скарги до Державної інспекції праці Республіки Польща щодо порушення трудових прав / зразок позову до судових органів Республіки Польща щодо захисту прав заробітчанина).
Здійснення неофіційного перекладу ключових законодавчих актів з питань трудової міграції з поясненнями практики їх застосування у країні перебування українського громадянина.
Запровадження безкоштовних он-лайн та телефонних юридичних консультацій з питань реалізації та захисту прав, законних інтересів українських громадян у країні перебування, а також можливості залучення до представництва інтересів відповідних фахівців.
Проведення серії тренінгів (вебінарів) для громадян, які працюють за кордоном чи мають намір виїхати за межі держави з метою пошуку роботи про їхні права, свободи та законні інтереси у країні перебування.
Створення та забезпечення функціонування громадської мережі правозахисних організації в Україні та за кордоном з питань захисту прав і свобод мігрантів, створення «Громадських офісів правового захисту українських заробітчан» (Польща, Чехія, Німеччина, Італія, Іспанія, Греція тощо).
Проведення інформаційних кампаній та круглих столів у країнах перебування українських заробітчан з питань реалізації та захисту їх прав та законних інтересів.
Пошук і залучення ресурсів для впровадження ідеї системного юридичного захисту прав, свобод та законних інтересів українських заробітчан.
Прогнози:
Розроблення системної та якісної державної політики у сфері трудової міграції.
Покращення правової обізнаності, правових знань та правової культури українських громадян.
Запровадження ефективних механізмів правового захисту та відновлення порушених прав та законних інтересів прав трудових мігрантів – громадян України.
Налагодження міжнародної співпраці у сфері трудової міграції та запобігання можливій дискримінації та нетерпимості до українців.

Legal protection of the rights and legitimate interests of ukrainian employees
The uneasy economic situation in the state and other circumstances forced, according to various estimates from 3 to 7 million Ukrainian citizens, to become labor migrants. Migrant workers and their families are hostage to this situation. On the other hand, and for our country there are significant threats to such migration processes.

The lack of adequate and basic legal knowledge of the legislation of the countries of residence of Ukrainian migrant workers contributes to various forms of violations of their rights, freedoms and legitimate interests, including labor rights, various forms of discrimination.
Migrant workers, depending on their host country, need at least protection and assistance from the state, as well as effective legal support and free legal counseling.
The available legal assistance capabilities are not sufficient for the comprehensive knowledge of Ukrainian citizens - labor migrants about their rights and mechanisms for their effective legal protection in the host country.
The widespread practice of discrimination on the grounds of nationality, intolerance and stereotypes in the host countries in relation to Ukrainian workers.
Goals:
Expert development, discussion and lobbying of the policy strategy in the field of labor migration, as well as preparation of changes to the Ukrainian legislation on relevant issues.
Improvement of legal education and awareness of Ukrainian citizens who work abroad or intend to go beyond the state to seek employment about their rights, freedoms and legitimate interests in the host country.
Ensuring the creation of a human rights network and legal support for the rights, freedoms and legitimate interests of Ukrainian workers.
Carrying out an information campaign on mechanisms for the implementation and protection of the rights of migrant workers, as well as to prevent discrimination and intolerance of relations with Ukrainian wage earners.

Informal translation of key legislative acts on labor migration with explanations of the practice of their application in the country of stay of a Ukrainian citizen.
The introduction of free on-line and telephone legal advice on the issues of the implementation and protection of rights, legitimate interests of Ukrainian citizens in the host country, as well as the possibility of attracting relevant specialists to the representation of interests.
Conduct a series of trainings (webinars) for citizens who work abroad or intend to go beyond the state to seek employment about their rights, freedoms and legitimate interests in the host country.
Creation and operation of a public network of human rights organizations in Ukraine and abroad on protection of the rights and freedoms of migrants, creation of "Public Offices for the Legal Protection of Ukrainian Workers" (Poland, Czech Republic, Germany, Italy, Spain, Greece, etc.).
Conducting informational campaigns and roundtables in the host countries of Ukraine on the issues of implementation and protection of their rights and legitimate interests.

La protection juridique des droits et des intérêts licites des travailleurs ukrainiens
La situation économique difficile dans l'État et d'autres circonstances ont contraint, selon diverses estimations, de 3 à 7 millions de citoyens ukrainiens à devenir des travailleurs migrants. Les travailleurs migrants et leurs familles sont pris en otage par cette situation. D'autre part, et pour notre pays, tels processus de migration sont gravement menacés.
Dans le même temps, notre État n'a pas encore mis au point de politique systématique en matière de migration de travail, de protection des droits des migrants et de retour des travailleurs ukrainiens dans leurs foyers.
Le manque de connaissances juridiques de base suffisantes sur la législation des pays de résidence des travailleurs migrants ukrainiens contribue à diverses formes de violation de leurs droits, libertés et intérêts légitimes, notamment les droits du travail et diverses formes de discrimination.
Les travailleurs migrants, selon leur pays d'accueil, ont au moins besoin de la protection et de l'assistance de l'État, ainsi que d'un soutien juridique efficace et de conseils juridiques gratuits.
Les capacités d'assistance juridique disponibles ne sont pas suffisantes pour permettre aux citoyens ukrainiens (migrants de travail) de bien connaître leurs droits et aux mécanismes permettant de les protéger efficacement dans le pays d'accueil.
La pratique généralisée de discrimination fondée sur la nationalité, l'intolérance et les stéréotypes dans les pays d'accueil à l'égard des travailleurs ukrainiens.
Les buts :
Développement par des experts, discussion et lobbying de la stratégie politique dans le domaine de la migration de travail, ainsi que préparation de modifications de la législation ukrainienne sur des questions pertinentes.
Améliorer l'éducation juridique et la sensibilisation des citoyens ukrainiens qui travaillent à l'étranger ou ont l'intention d'aller au-delà de l'État pour chercher du travail sur leurs droits, libertés et intérêts légitimes dans le pays d'accueil
Assurer la création d'un réseau des droits de l'homme et d'un soutien juridique pour les droits, libertés et intérêts légitimes des travailleurs ukrainiens.
